Wednesday 4th October 2023 at 7.00pm – at Utterby Village Hall

  • It was noted that there had been no noise issues regarding the Equinox Festival.
  • Cllr Mossop reported that he had been notified by Platform Housing that Benson Court would be sold for redevelopment.

34  Minutes
a) It was RESOLVED to approve the minutes of Parish Council Meeting 5th July 2023 as correct and the Chairman signed them. The public forum notes from the meeting (not quorate) on 6th September were signed as a record.

35  Council Matters, Actions and Communications
a) Chairman’s Remarks. Nothing to report
b) Clerk’s Report.  The Clerk she had obtained a key for the cabinet (originals gone astray), but that the number had been misread and so would order a new set.

c) Consultations – LCC consultation under LCC item.

d) Communications were noted from: Lincolnshire Community Foundation regarding grants; Cllr Edward Mossop regarding Benson Court storage of building materials; Lives request for funding; Dept of Health and Social Care regarding grants; Village resident regarding her communications ref A16 speeding with the local MP.

i. Utterby Academy- It was RESOLVED that the Clerk would reply to the academy and suggest that they ask Cllr Hall (LCC) to visit them.

ii. Utterby Village Hall – increase in price noted which was somewhat offset by the cupboard charge being dropped. It was RESOLVED that the Chairman sign the rental agreement. The Clerk read out the information regarding fire safety.

iii. Lincolnshire Police - It was RESOLVED that the Chair would attend the online Teams quarterly meeting that Parish Council Chairs had been invited to.

        e) Financial Regulations - It was RESOLVED to Update the Council’s Financial Regulations with reference to the online bank account.

f) Village Hall – a) It was RESOLVED that a Member of the Parish Council would sit on the Village Hall Management Committee /Trust, and that the membership of the appointed Member be reconsidered on an annual basis at the Annual Parish Council meeting.  b) It was RESOLVED to appoint Cllr Tina Bryan as the member of the Parish Council to sit on the Village Hall Management Committee /Trust until it’s consideration again at the May Annual Parish Council Meeting (TBC May 2024). To note that should Cllr Tina Bryan (as the appointed member) resign or no longer be a member of Utterby Parish Council, that they would automatically be released from being a member of the Village Hall Management Committee/Trust and a new Councillor would be appointed.

36  Finance and Budgets

  1. Quarterly Monitoring – It was RESOLVED to approve the quarterly monitoring for beginning April 23 to end June 23 which was checked prior to the meeting by Cllr JW and Cllr TTB.
  2. It was RESOLVED to ratify payments authorised by emails in July/August: Utterby Parish Council (Unity Trust bank)- deposit for new account £500.00 #100659 ref 658, HM Revenue and Customs Only120PX00376161 - July 2023 tax £31.20 IB 4/8/23 ref 659, DW Gibbs - August bus shelter cleaning £30.00 IB 4/8/23 ref 660, Utterby Parish Council - Payment to go into Unity Trust Account £2,000.00 #100660 ref 661, Clerk - July salary and expenses £354.10 #100661 ref 662.
  3. Clerk – It was RESOLVED to approve the extra hours to the contracted hours paid for in the Clerk’s August hours (as previously agreed by Council).
  4. It was RESOLVED to ratify the payments made September 6th 2023 following the meeting which was not quorate.   1. Payments – It was RESOLVED to approve the payments and to accept the Bank Reconciliation. HM Revenue and Customs Only120PX00376161 September 2023 tax £5.80 ref 669, DW Gibbs October bus shelter cleaning £30.00 ref 670, Clerk September salary and expenses £225.07 ref 671, David Buckley (D H B Gardening Services) Village Green hedge, Hedge corner Church Lane, and Kissing Gate £220.00 ref 672, Utterby Village Hall Meeting April, May, June, July, Sept £123.00 ref 673, Glendale Countryside Ltd Verges and Village Green September 2023 £140.93 ref 674.
  2. It was RESOLVED to close the HSBC bank account moving all current funds into the Unity Trust account. Cllr TTB checked the account details for the transfer and Cllrs AW, TB, JB and the Clerk signed the form.

 

37  Planning

  1. A brief discussion took place regarding unofficial plans for a further planning application to the field behind the Village Hall. These plans might be very advantageous for the Village Hall however, it was also noted that it might block out the last envelope of a countryside view for a resident on Grange Lane. As the planning application has not yet been made, it was considered that no further discussion should take place until it was official.
  2. Any urgent planning applications to consider – none.
  3. It was noted that the Parish Council’s complaints regarding N/192/00289/17 LAND OFF CHAPEL LANE AND, GRANGE LANE, UTTERBY NATURE OF INVESTIGATION: Breach of condition 3 and condition 8 on Planning Permission had not been found to contravene the permissions given.

 

38  Parish Council Amenities (bus shelters, village green, etc)

  1. Welcome Pack – nothing to report.
  2. Village Green and Verges - the grass had been cut, but there was concern at how poorly the contractors had performed this year.

i. Land Registry -The Clerk reported that the land registry information for the Village Green land had now been changed with her contact details.
ii Following consideration of the plan of location of daffodils on the verges, it was RESOVLED to ask David Buckley for a quote to buy and plant more daffodils.

  1. Trees – Cllr AW had looked at trees from Woodthorpe Garden Centre. It was RESOLVED to buy 3 or 4 more trees (budget of £300) to replace those that had died on the Village Green and to ask David Buckley for a quote to plant them.
  2. Tidy Up Week review – Cllr AW listed some of the many projects he undertook including clearing the drains down Holywell Lane and Grange Lane.
  3. Bus shelters – The contractor had reported concerns of drug use in the shelter. Cllrs to keep a check on the shelters.
  4. Telephone Box – Following receipt of paint from BT Openreach, it was RESOLVED that a volunteer resident who had offered to do the work, would repaint the telephone box as it was in such poor condition.
  5. Utterby Voice feedback – The Church rep had emailed to thank the Council.
  6. Kissing gates – It was RESOLVED that the Clerk would get some quotes to refurbish/replace the Kissing Gates on Church Lane and the A16.
     

39     ELDC/LCC Services (Streetlights, Bins, Highways, Verges, Footpaths, etc)

  1. A16 speed limit –the new proposal from LCC (passed to us by Cllr Hall) to reduce speed limit on part of main road to 30mph was briefly discussed, but the Council had not even got a date when this proposal was to go forward.
  2. NHT public Representative Online Survey - Lincolnshire County Council. It was RESOLVED that the Chair, Cllr AW would complete this on behalf of the parish council and send it to the Clerk to input online.
  3. Parking bays outside Bank Cottage, Main Road, Utterby. – It was RESOLVED that the parish council would support this request and that the Clerk would contact Cllr Hall (LCC) to ascertain the best method to apply to LCC.
  4. Any urgent issues or updates - None
  5. Benson Court –It was noted that the containers would continue to be used by Platform Housing and that there were no plans to remove them any time soon.
  6. A16/Church Lane – It was RESOLVED that the Clerk would ask David Buckley to include trimming the corner blind junction as recently undertaken three times a year (same time as cutting the Kissing Gate path).

  • There was a general discussion regarding various issues including the condition of the Kissing Gates, telephone box, the complaints telephone line for the forthcoming Equinox festival, feasibility of a parking bay on the A16 outside the last set of houses going out towards Grimsby and planning issues relating to the development between Grange Lane and Chapel Lane alongside the land behind the Village Hall.

As the meeting was not quorate, the Parish Council meeting could not be held and so following the public forum those present left at 7:22pm.

  • A resident expressed their concern regarding the condition and wellbeing of the horse in the field off Queen’s Close.

24  Minutes
a) It was RESOLVED to approve the minutes of Parish Council Meeting 7th June 2023 as correct and the Chairman signed them.

 

25  Council Matters, Actions and Communications
a) Chairman’s Remarks. Nothing to report
b) Clerk’s Report.  The Clerk reported that an error had been made on her payment last month and so this month she had deducted the over payment. The Clerk advised the Council that she was 26 hours over her working time and that, as agreed earlier in the year, she would add 10 hours to her July pay and then any further outstanding hours to September’s pay.
c) Consultations – The Engagement opportunity relating to Drug Misuse was noted by Councillors.

d) Communications were noted from: LCC regarding the letter sent from Victoria Atkins (MP) about the A16 speeding issue, Finding Fitness wall climbing and a Difib Fund now available.

26  Finance and Budgets

  1. It was RESOLVED that Cllrs TTB and JW would undertake the quarterly monitoring each quarter.
  2. The Council noted that the Clerk would shortly be making the submission to Unity Trust bank to open a bank account (including online transactions) for the Parish Council with current signatories, as per resolution in 2022. Once this account was in place the HSBC account would be closed.
  3. It was RESOLVED to approve the payments schedule due: HM Revenue and Customs Only120PX00376161 June 2023 Tax £5.80, Clerk Salary and expenses in June 2023 £228.17, DW Gibbs July 23 Bus shelter and phone box £30.00, Clerk – reimbursement Utterby Voice £127.35, ELDC payment for election admin  £48.50. TOTAL £439.82.
  4. The council noted that notification had been received from the external auditors PKF Littlejohn LLP that they had received and logged the notification of exempt status for the year ended 31 March 2023.
  5. It was RESOLVED that a payment schedule be sent by email to all Councillors at the beginning of August for August 2023 payments so that these can be approved by all Councillors (at least 3 if Councillors away on holiday) and paid then payments ratified at the September meeting 2023.

 

27  Planning

  1. Urgent planning applications to consider – None.
  2. Updates from any other planning issues – 192/00505/22/N Development Grange Lane/Chapel Lane. It was noted that Planning Enforcement were investigating the complaint regarding the barriers.
    N/192/00966/23 –Langdale: This application had been approved by ELDC. Some councillors expressed their concern regarding the size and material used to create the wall which wasn’t included in the application, and that it appeared that one letter of objection, which AW considered very well written, had obviously been dismissed altogether.  Planning Application N/192/01118/23 : Honeysuckle Cottage had also been approved.  Further concerns were raised regarding the Grange Lane/Chape Lane development 192/00505/22/N as it appeared that one development was now going to be using concrete instead of brick for the build. Councillors would email the Clerk photographs if this was indeed the case so that they could be sent to Enforcement.
     

28  Parish Council Amenities (bus shelters, village green, etc)

  1. Welcome Pack. A new resident had been given a pack.
  2. Verges and Village Green – Following complaints regarding the state of the verges and Village Green, the Clerk had emailed Glendale to complain about the very poor first cut and then the delay in a further cut. The Clerk would now email Glendale a photo of just how terrible the grass looked as it was so long.
  3. Trees – Cllr AW would price up some saplings and bring it to the next meeting so that they could be purchased and planted end September/October.
  4. Tidy Up Week – This was 6th August for a week. It had been included in the Utterby Voice. It is intended that all residents do their own area, it would not be a ‘organised’ tidy up.
  5. Bus Shelters – Nothing to report.
  6. Utterby Voice – This had been delivered that day and would be delivered by councillors.
  7. Noticeboard – Although the noticeboard was now sited, unfortunately it leaked very badly through the doors so Cllr AW was going to contact Mr M. to find out if there were any rubber seals we could use.

29     ELDC/LCC Services (Streetlights, Bins, Highways, Verges, Footpaths, etc)

  1. Bin application – Nothing had been received back yet from ELDC.
  2. Benson Court – It was RESOLVED that the Clerk would email Platform Housing to complain about the shipping containers and portaloo outside Benson Court.
  3. A16 Speeding - The Clerk read out the letter from LCC to Victoria Atkins (MP). Councillors were all sceptical about the statistics given regarding speed monitoring as they were very vague with without dates and times. Cllr Alex Hall (LCC) would investigate further.
  4. A16 Church Lane Blind Junction – It was RESOLVED that the Clerk would contact David Buckley and request that he trim along the bushes at the junction as per last year.

  • A resident advised the council that barriers with notices had been erected on Grange Lane to prevent entry to traffic onto the development site between Grange Lane and Chapel Lane. Further the resident said the brick dust was so bad he had to go to hospital as it had increased his asthma condition considerably. See planning item.

16  Finance and Budgets

  1. It was RESOLVED that the Parish Council would pay for the Clerk’s SLCC membership again for 2023/24.

b)It was RESOLVED that the decision to choose two councillors to undertake the quarterly monitoring each quarter be deferred to the next meeting.

  1. The council noted that the AGAR has been sent by email and received by PKF Littlejohn LLP and that the information was now on the website and PC notice board.
  2. It was RESOLVED to approve the payments schedule due: HM Revenue and Customs Only120PX00376161, May 2023 Tax-£5.80; Clerk, Salary and expenses in May 2023-£238.07;DW Gibbs; June 23 Bus shelter and phone box-£30.00; SLCC Membership for Clerk- £80.00; J Woodward, Plants and plant food/peat-£76.23, David Buckley, Kissing gate and hedges- £125.00, Glendale Countryside Ltd, Verges and Village Green May 2023-£140.93 TOTAL £696.03. It was also noted that Cllr AW and JW would have to sign the cheques due to lack of signatories at the meeting, but that Cllr JW would ask Cllr MW to sign the cheque (along with Cllr AW) to reimburse her for payment for peat and flowers.

 

17  Planning

  1. Urgent planning applications to consider – Planning Application N/192/01118/23 – Honeysuckle Cottage, Main Road- It was RESOLVED that the parish council had no comment to make.
  2. Updates from any other planning issues – 192/00505/22/N Development Grange Lane/Chapel Lane. It was noted that barriers had been put in place at the entrance on Grange Lane into the development site deterring all traffic to use that entrance, and instead they were entering via Chapel Lane and Jacob’s Close. Also the brick dust being generated from brick cutting was causing an issue with a resident. It was RESOLVED that the Clerk would write to Enforcement with photos to see if they were able to assist.
    N/192/00966/23 – It was noted there were two neighbourhood objections to the Langdale application. Cllr AW said that she had finally spoken to Heritage Lincolnshire and they said that the planning application did not affect the architecture of the church but the setting, and that this was no concern of Heritage Lincolnshire. Cllr JW understood that Cllr Mossop (ELDC) had also looked at the site.


18  Parish Council Amenities (bus shelters, village green, etc)

  1. Welcome Pack. Two new residents to be given a pack.
  2. Verges, Trees and Village Green – Cllr AW confirmed that the three whips we had been given had died and that he would like to look at replacing them on a future agenda. It was RESOLVED that Utterby would have a Tidy Up week from Sunday August 6th to Saturday August 12th.
  3. Bus Shelters – Nothing.
  4. Utterby Voice -  Clerk to include the Tidy Up Week. Much of this edition will be the annual reports.
  5. Noticeboard – Clerk to follow up with Dave Skells regarding the erection of the noticeboard.

a.    It was RESOLVED to elect Cllr Alan Woodward as the Chairman of Utterby Parish Council.

    Item in planning which is next door to St Andrew’s Church - Cllr A and W Woodward are on the DCC of St Andrew’s Church (not a pecuniary interest).

4.    Minutes
It was RESOLVED to approve the minutes of the Parish Council Meeting 5th April 2023 as correct and the Chairman signed them.

5.      Council Matters, Actions and Communications
a.    Co-option of a Councillor. The Council RESOLVED that it was not necessary to go in Closed Session. It was RESOLVED that Tina Bryan be elected as Councillor to fill the single vacancy for the Parish Council.
b.    Chairman’s Remarks. The Chairman expressed his delight that so many councillors had stood again for the Parish Council.
c.    Clerk’s Report. The Clerk reported  that her membership was now due for the SLCC (£80) and would be requesting at the next meeting that the council pay again for this.  She confirmed that the domain name had now been paid for and so new emails would be sent out imminently. Now that we had a full council the Clerk would proceed with changing the bank account to Trinity (Resolved on previously). The Clerk was still waiting for a reply regarding the change of C/O address for the land registry of the Village Green.
d.    Following a review it was RESOLVED to accept the Asset Register as circulated to Councillors as of end March 2023.
e.    It was RESOLVED to approve Standing Orders with no changes apart from date.
f.    It was noted that the Financial Regulations were reviewed and updated in February 2023.
g.    It was RESOLVED to approve the Code of Conduct with no changes apart from date.
h.    It was RESOLVED to approve the Complaints Procedure with no changes apart from date and the address of ELDC.
i.    There were no current consultations to review, but the Clerk highlighted the Viking pipeline consultation previously circulated by email to councillors (expiry date passed).
j.    Communication was received and noted regarding hedgehog doors through fences, suggested to included in the Utterby Voice. 
6    Finance and Budgets
a)    It was RESOLVED to approve the quarterly monitoring January to end March 2023 checked in April 2023 by Cllrs J Woodward and Cllr N Gallant (no longer a councillor) and the new budget 2023-24.
b)    It was RESOLVED to ratify the decision to approve agreement of quote (by email) for the third year of the Parish Council’s Insurance policy (3 year term) of £511.54 due 01/06/2023 from AJG Community Schemes Gallagher insurance.
c)    It was RESOLVED to ratify the approved all the payments (by email 5th April HM Revenue and Customs Only 120PX00376161, April 2023 Tax £5.60, Clerk Salary and expenses in April 2023 £243.49, DW Gibbs May 23 Bus shelter and phone box £30.00, Glendale Countryside Ltd Verges and Village Green April 2023 £140.93, Cloud Next Ltd .gov.uk domain and email accounts     £251.98, Gallagher Insurance £511.54 £511.54
d)    It was RESOLVED to receive and note the Internal Auditor’s report.
e)    Annual Governance and Accountability Return 2022/23
i.    It was RESOLVED to agree that the Council was eligible to apply for the Certificate of Exemption, it was approved and authorised that the Chairman and Parish Clerk sign it and that the Parish Clerk send it to the auditors, PKF Littlejohn LLP. 
ii.    The Annual Governance Statement was reviewed; it was RESOLVED to approve it and authorise that the Chairman and Parish Clerk sign it.
iii.    Following the presentation of the Accounting Statements certified by the Responsible Finance Officer, the Council approved them and authorised the Chairman to sign them.
f)    It was RESOLVED to approve the Bank Reconciliation and Explanation of Variances.
g)    It was RESOLVED to approve the Notice of Public Rights and Publication of Annual Governance and Accountability Return.
h)    It was noted that the contact information for the Chairman and Clerk be sent to PKF Littlejohn LLP.

7    Planning 
a)    Planning Application - N/192/00966/23 Langdale. It was RESOLVED that the Council chose to make not comment regarding this application. 
b)    Planning Updates – It was reported that noted that the application for development off Queen’s Close had been refused by ELDC. 

8    Parish Council Amenities (bus shelters, village green, etc)
a)    Welcome Pack. Nothing to report
b)    Utterby Tidy Up Campaign 2023– To add to the next agenda and set a date then in August.
c)    Verges and Village Green – Nothing to report. 
d)    Bus Shelters – The Bus Shelter outside Benson Court had now been painted.
e)    Utterby Voice – Due to be printed in July 2023. Include information regarding robberies in village and stealing of spare car keys.

9    ELDC/LCC Services (Streetlights, Bins, Highways, Verges, Footpaths, etc)
a)    It was noted that the Clerk was still waiting for a reply regarding the dog bin application.
b)    The tidy up by ELDC Pride team along the footpath of the A16 through the village had been noted and very much appreciated and RESOLVED that the Clerk would email to thank them.
